Our Service Booking Agreement
By booking, paying, signing, electronically accepting, or proceeding with photography services, the Client acknowledges they have read, understood, and agreed to the terms of this Agreement.
This Agreement is subject to the Australian Consumer Law and nothing in this Agreement excludes, restricts, or modifies any consumer guarantees, rights, or remedies that cannot legally be excluded.
1. Photography Services
Photo Bling Shots agrees to provide photography services as described in the Client’s invoice, booking confirmation, proposal, package selection, or other written confirmation (“Services”).
The specific details of the Services, including the selected package, photography date, location, coverage details, deliverables, image quantity, inclusions, upgrades, additional services, and agreed fees will be outlined in the Client’s invoice and/or booking confirmation.
The Client acknowledges that photography is a creative service and that final images will reflect Photo Bling Shots’ professional artistic style.
Photo Bling Shots, including any assigned photographer, retains full creative and editorial control over:
- photography style
- composition
- lighting
- posing direction
- image selection
- editing style
- final artistic decisions
The Client acknowledges that not every photograph captured during the session or event will be delivered, and final image selection remains at Photo Bling Shots’ professional discretion.
2. Photographer Assignment & Team Members
The Client acknowledges that Photo Bling Shots operates as a photography business and may provide photography services through the business owner, employees, contractors, associates, or other suitably qualified photographers.
Unless specifically agreed in writing, the Client is booking photography services with Photo Bling Shots and is not booking a specific individual photographer.
Photo Bling Shots reserves the right to assign an appropriate photographer or photography team member to perform the Services where reasonably required, including due to availability, illness, emergencies, scheduling requirements, workload, or business operations.
Photo Bling Shots remains responsible for managing the Services and maintaining professional standards.
The Client acknowledges that the assigned photographer may vary unless a specific photographer has been agreed in writing before the booking.
3. Fees & Payment Terms
The total investment, booking fee, payment schedule, and any additional charges relating to the Services will be outlined in the Client’s invoice, booking confirmation, proposal, or written agreement.
A booking fee is required to secure the Client’s chosen photography date and time.
The Client acknowledges that the booking fee reserves Photo Bling Shots’ exclusive availability, prevents other bookings from being accepted during that period, and covers preparation, planning, administration, communication, and business costs associated with the booking.
The booking fee is non-refundable except where required under Australian Consumer Law.
Unless otherwise agreed in writing, the remaining balance must be paid by the due date stated in the Client’s invoice or booking confirmation.
Final images, galleries, products, or services will not be delivered until all outstanding payments have been received in full.
Where payment remains overdue, Photo Bling Shots reserves the right to engage reasonable debt recovery services and recover reasonable costs associated with recovering outstanding amounts.
4. Cancellation Policy
Due to limited availability, cancellations may result in lost booking opportunities for Photo Bling Shots.
The following cancellation terms apply:
Cancellation more than 14 days before session:
- Booking fee remains non-refundable.
- Any additional payments may be refunded where applicable.
Cancellation within 14 days of session:
- Booking fee remains non-refundable.
- Photo Bling Shots may charge fees reasonably reflecting preparation, lost availability, and business costs.
Cancellation within 7 days of session:
- The Client acknowledges the Photographer may have declined other bookings for this time.
- The remaining session fee may become payable.
Photo Bling Shots may consider genuine emergencies or exceptional circumstances on a case-by-case basis.
Nothing in this clause excludes rights available under Australian Consumer Law.
5. Rescheduling Policy
For the safety and wellbeing of all clients and the Photographer, sessions should be rescheduled where the Client or any participant is experiencing:
- contagious illness
- fever
- flu symptoms
- vomiting
- significant sickness
- conditions affecting safety or participation
The Client agrees to notify Photo Bling Shots as soon as reasonably possible.
Rescheduling due to illness is subject to availability.
6. Illness & Sickness Policy
For the safety and wellbeing of all clients and the Photographer, sessions should be rescheduled where the Client or any participant is experiencing:
- contagious illness
- fever
- flu symptoms
- vomiting
- significant sickness
- conditions affecting safety or participation
The Client agrees to notify Photo Bling Shots as soon as reasonably possible.
Rescheduling due to illness is subject to availability.
7. Weather & Force Majeure
Photo Bling Shots is not responsible for delays, cancellations, or inability to perform services due to circumstances outside reasonable control, including:
- extreme weather
- storms
- natural disasters
- illness
- accidents
- equipment failure
- government restrictions
- venue restrictions
- emergencies
Where reasonably possible, the session will be rescheduled.
If Photo Bling Shots must cancel due to circumstances within its reasonable control, the Client may receive a refund of payments made or transfer the booking to another available date.
8. Client Requested Changes
Any changes requested after booking, including:
- date changes
- location changes
- package upgrades
- additional participants
- additional services
- extended session time
are subject to availability. Additional fees may apply where changes require extra preparation, travel, time, equipment, or resources.
9. Late Arrival Policy
Photography sessions are reserved for a specific timeframe.
Late arrival by the Client or participants will reduce available photography time.
The Photographer is not responsible for reduced image quantity or missed photographs caused by late arrival.
Sessions generally cannot be extended beyond the agreed finishing time unless additional time is available and purchased.
10. Client Responsibilities
The Client is responsible for:
- arriving on time
- preparing appropriately for the session
- ensuring all participants cooperate
- communicating important requirements before the session
- ensuring necessary permissions are obtained
Photo Bling Shots is not responsible for missed photographs or reduced outcomes caused by:
- lateness
- lack of cooperation
- participant behaviour
- personal preferences
- circumstances outside the Photographer’s control
11. Children, Minors & Event Photography Consent
Where children or minors participate in photography services, the Client confirms they are the parent, legal guardian, event organiser, or authorised representative responsible for obtaining any necessary permissions and consent.
The Client confirms they have the legal authority and permission to provide consent for any minors participating directly in the photography session or event.
The Client is responsible for informing parents, guardians, and relevant participants that photography will take place during the event or session.
The Client agrees to obtain any required consent from parents or legal guardians of minors who may be photographed.
The Client is responsible for supervising children during the session or event and ensuring their safety.
Photo Bling Shots is not responsible for obtaining individual consent from every attendee at a private event where the Client or event organiser has engaged the Photographer and accepted responsibility for communicating photography arrangements and permissions.
The Client acknowledges that Photo Bling Shots cannot guarantee that children or minors will not appear incidentally in background images, group photographs, or candid event coverage.
Photo Bling Shots is not responsible for missed images, shortened sessions, or reduced photographic outcomes caused by children’s behaviour, mood, cooperation, safety concerns, or circumstances outside the Photographer’s reasonable control.
Where images containing identifiable minors are intended for website, social media, advertising, portfolio, or promotional purposes, Photo Bling Shots will only use such images where appropriate permission has been provided by a parent, legal guardian, or authorised representative.
12. Safety & Photographer Discretion
The Photographer reserves the right to pause, modify, relocate, postpone, or stop a session where conditions are considered unsafe.
This includes:
- dangerous weather
- unsafe locations
- hazards
- aggressive behaviour
- inappropriate conduct
- risk to people or equipment
The Photographer’s decision regarding safety will be final.
13. Location Permissions & Access
The Client is responsible for obtaining permission, permits, approvals, or access requirements for:
- private properties
- venues
- event locations
- restricted areas
Photo Bling Shots is not responsible for restrictions, closures, venue rules, access limitations, or decisions made by property owners, councils, venues, or third parties.
14. Travel Fees
Photography services outside the standard Photo Bling Shots service area may require additional travel fees.
Any travel charges will be communicated and agreed before the photography session.
15. Image Selection & Delivery
The Photographer will professionally select and edit images based on:
- technical quality
- artistic standards
- storytelling
- composition
- lighting
Not every photograph captured during the session will be delivered.
Unselected images, duplicates, test images, technically unsuitable images, and RAW files are not included unless specifically agreed in writing.
Edited images will be delivered through an online gallery within the estimated timeframe stated in the Client’s package information.
Delivery times are estimates and may vary due to workload, circumstances, or unforeseen events.
16. Editing Style & Client Expectations
The Client confirms they have reviewed Photo Bling Shots’ portfolio and understands the Photographer’s artistic style.
Editing may include:
- colour correction
- exposure adjustments
- cropping
- standard retouching
- image enhancement
Additional charges may apply for requests including:
- extensive retouching
- body modifications
- background replacement
- object removal
- advanced editing
Dissatisfaction based only on personal preference or expectations different from the Photographer’s established style does not constitute grounds for refund.
This clause does not limit rights under Australian Consumer Law.
17. RAW Files
RAW files are not included.
RAW files remain the property of the Photographer and will only be provided where specifically agreed in writing and subject to additional fees.
18. Image Storage & Backup
The Client is responsible for downloading and safely storing delivered images.
Photo Bling Shots does not guarantee indefinite storage of galleries or files.
Archived files may be deleted after the stated storage period.
The Photographer is not responsible for loss of files after delivery and the Client’s opportunity to download images.
19. Copyright & Image Usage
All photographs remain the copyright property of Photo Bling Shots.
The Client receives a personal, non-commercial licence to use delivered images for:
- personal sharing
- printing
- personal social media use
Commercial use, resale, advertising, or business use requires written permission.
The Client must not significantly alter, edit, filter, or modify delivered images without permission.
20. Model Release & Promotional Use
The Client grants Photo Bling Shots permission to use selected images for:
- website portfolio
- social media
- advertising
- marketing materials
- competitions
- promotional purposes
This permission is worldwide and royalty-free.
The Client may request to opt out of future promotional use by providing written notice before the photography session.
Images already published, printed, distributed, or archived before receiving the request do not need to be removed.
21. Minor Image Use & Marketing Permission
Photo Bling Shots may photograph children and minors during photography services for the purpose of providing the contracted Services.
The Client acknowledges that the use of images containing identifiable minors for promotional purposes, including website galleries, social media, advertising, competitions, portfolio displays, and marketing materials, requires appropriate consent.
Where images containing identifiable minors are intended for promotional use, Photo Bling Shots will only use such images where permission has been provided by a parent, legal guardian, or authorised representative.
The Client may request that specific images or identifiable minors are excluded from promotional use by providing written notice to Photo Bling Shots.
Photo Bling Shots respects reasonable privacy requests and will take reasonable steps to avoid future promotional use of identified images where valid objections or restrictions have been communicated.
22. Privacy
Photo Bling Shots collects and uses Client information only for purposes related to:
- providing services
- communication
- administration
- invoicing
- business operations
Client information will be handled in accordance with applicable Australian privacy laws.
23. Limitation of Liability
To the maximum extent permitted by law, Photo Bling Shots is not liable for:
- indirect loss
- consequential loss
- loss of opportunity
- loss of data after delivery
- circumstances outside reasonable control
Where liability cannot legally be excluded, liability will be limited to the remedies available under Australian Consumer Law.
24. Indemnity
The Client agrees to indemnify Photo Bling Shots against claims, damages, losses, or expenses arising from:
- breach of this Agreement
- misuse of images
- failure to obtain required permissions
- actions of participants under the Client’s responsibility
25. Dispute Resolution
If a dispute arises, both parties agree to first attempt to resolve the matter through reasonable communication and good faith discussions before commencing legal proceedings.
Nothing prevents either party from exercising rights available under Australian law.
26. Booking Confirmation & Supporting Documents
The Client acknowledges that the invoice, booking confirmation, proposal, package details, questionnaires, and any written agreements provided by Photo Bling Shots form part of this Agreement.
Where there is a conflict between this Agreement and specific booking details, the specific written booking details will apply only to the relevant service details, fees, dates, and deliverables.
27. Governing Law
This Agreement is governed by the laws of New South Wales, Australia.
The parties submit to the jurisdiction of NSW courts.
28. Entire Agreement
This Agreement represents the complete understanding between the parties and replaces any previous discussions, communications, or representations relating to the Services.
Any changes must be agreed in writing.
29. Electronic Acceptance
The Client may request one reschedule with at least 72 hours notice, subject to Photographer availability.
Rescheduled sessions must generally occur within 12 months of the original booking date unless otherwise agreed.
Additional rescheduling requests may incur additional fees.
